The Vietnamese government has issued Decree No. 59/2026/ND-CP, a new regulatory framework that clarifies how the country handles administrative violations and deportations for foreign nationals. Taking effect on April 1, 2026, this decree replaces older legislation to provide a more transparent process for management and enforcement.

The updated rules apply to all foreign individuals, including digital nomads, expats, and investors. It is important to note that deportation under this decree is categorized as an administrative sanction rather than a criminal one. The government is formalizing existing procedures to ensure authorities and foreigners alike understand the legal steps required when a violation occurs.

Under the new rules, individuals facing deportation have specific rights:

  • Receipt of a formal decision at least 48 hours before enforcement.
  • The right to contact their country’s diplomatic or consular office.
  • Access to an interpreter and the right to request a legal reconsideration.
  • Permission to take lawful assets out of the country upon departure.

Authorities can postpone deportation if the individual has a serious illness, outstanding civil or economic obligations, or is involved in an ongoing legal case. However, during the waiting period, officials may restrict movement to a designated area or temporarily hold passports to prevent absconding.
