Understanding Spain’s Streamlined Immigration Rules
Spain has approved a major immigration reform extending student visa validity for the full duration of studies and simplifying the 'arraigo' residency process. The update also introduces a specific residency category for family members of Spanish citizens and streamlines work permit renewals.
Understanding Spain’s Streamlined Immigration Rules
Spain has significantly modernized its immigration framework, moving away from a patchwork of temporary fixes toward a more stable system for foreign residents. These updates, established under Royal Decree 1155/2024, prioritize long-term residency and immediate work rights for those already integrated into Spanish society.
The most impactful change is the creation of a unified five-year residence and work permit for family members of Spanish citizens. This replaces the previous "family arraigo" system, granting spouses, partners, and children immediate rights to live and work without the old bureaucratic hurdles. Additionally, the government has simplified the arraigo (roots-based) residency path, lowering the required stay in Spain to just two years for most categories.
Who it affects
The updated rules offer major advantages for several groups:
- International Students: Visas now align with the entire duration of a study program, ending the need for annual renewals. Students can also work up to 30 hours per week and transition to work permits without the previous three-year waiting period.
- Expats and Families: Spouses, registered partners, and dependent children or parents of Spanish nationals gain a stable five-year permit with full work authorization.
- Digital Nomads and Remote Workers: Those transitioning from other visas or seeking to regularize their status benefit from faster processing and streamlined work permit renewals, which can now be submitted 60 days before expiry.
What to do
If you are currently in Spain or planning a move, keep these practical steps in mind. Students must provide proof of enrollment, financial means, and academic progress to secure their full-term authorization. Family members should prepare documentation of their relationship, such as marriage certificates or proof of cohabitation for at least one year.
For those pursuing residency through the arraigo path, you must demonstrate a two-year continuous stay and provide a valid job offer or enrollment in a specific training program. Most applications can now be handled via the government’s updated digital platforms or at local Extranjería offices. Application fees generally range between €80 and €100.
