Immigration New Zealand is restructuring how open work visas function to provide better clarity on employment rights. Starting April 20, 2026, these visas will be split into two distinct categories that dictate whether a holder can work for themselves or must remain an employee.

The change primarily impacts how "open" these visas actually are. While you can still work for almost any employer without a pre-existing job offer, the specific conditions attached to your visa will now depend on which stream you fall under.

Understanding the Two Categories

The new framework divides visa holders based on their specific situation:

  • Category 1 (Self-Employment Permitted): This includes Post Study Work Visas and most partner-based work visas. Holders in this group can be employees, start a business, or work as freelancers and sole traders.
  • Category 2 (Employer-Based Only): This applies to Working Holiday Visas and various protection-based visas. Holders are restricted to employment agreements or contracts for services and cannot operate their own businesses.

All visa holders remain prohibited from providing commercial sexual services or directly employing others through their own business entities.

Who is Affected

For digital nomads and remote freelancers, this update is largely positive for those on partner or post-study tracks, as it formalizes the right to run a freelance business. However, travelers on Working Holiday Visas face tighter restrictions; they must stick to traditional employment and cannot set up independent business operations while in the country.

If you are already in New Zealand on an open work visa, these changes do not apply to you immediately. Your current conditions remain valid until your visa expires. The new rules only kick in for visas granted on or after April 20, 2026.

There are no new fees or separate application forms to worry about. The updated conditions will be automatically attached to your visa upon approval. If you are planning to work as a freelancer, ensure your visa falls under Category 1 before you begin taking on visa updates or local NZ clients.

For those simply working remotely for overseas companies while on a visitor visa, a 2025 policy remains in place allowing you to do so indefinitely without needing a work visa, provided you do not work for New Zealand-based entities.
